Florida healthcare advertising, telehealth and privacy rules

Florida in brief. Florida is in PSYPACT, so a psychologist licensed here can apply to treat clients by telehealth in the other PSYPACT states. Florida has enacted the Counseling Compact, which wasn't live here yet when we checked. Florida's privacy law covers health data but only reaches very large companies. Below: what Florida's licensing boards allow in advertising, with links to the official text.

Florida licensing boards’ advertising rules

Ads, websites and directory profiles all count as advertising to a licensing board. These are the Florida rules we check copy against, with links to the official text. Boards update their rules, so read the current version before you rely on a summary.

Every Florida health care practitioner

  • Any advertisement for health care services that names the practitioner must identify the type of license they hold. (Fla. Stat. 456.072(1)(t))
  • Ads for free, discounted or reduced-fee services must carry the statutory notice, in capital letters, about the patient's right to refuse to pay for other services. (Fla. Stat. 456.062)

Florida Board of Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling

  • LCSWs, LMFTs and LMHCs must use their license title or initials on promotional materials that name them. (Fla. Stat. 491.0149)

Telehealth across Florida's borders

Florida is a PSYPACT state. A psychologist whose home license is in Florida can apply for PSYPACT's telepsychology authorization and then see clients by telehealth in the other PSYPACT states, so ads can reach clients there too.

Florida has enacted the Counseling Compact, but it wasn't live here yet when we checked. Once it is, a licensed professional counselor based here can apply for privileges to practice in other member states instead of a separate license in each.

For physicians, psychiatrists included, Florida is in the Interstate Medical Licensure Compact, which speeds up getting a license in other member states but doesn't replace it.

Telehealth ads should only reach places where the clinician can legally treat: see PSYPACT and Counseling Compact states.

Practices near a state line often see clients from next door. Georgia and Alabama each have their own page.

Health data, tracking and Florida law

Florida's Digital Bill of Rights treats health data as sensitive, but it only applies to very large companies (over $1 billion in yearly revenue), so it rarely reaches a practice directly.

This is not legal advice.

Of the cities measured, Orlando gets the most of these searches. Its biggest single search, “gastroenterologist orlando”, gets about 1,600 a month. To turn a cost per click into a cost per booked patient, put your own numbers into the patient acquisition cost calculator.

Across the searches measured here, Florida patients look most for gastroenterologists (about 4,450 a month), then therapists (3,020). Orlando alone accounts for 25% of them. A click on a gastroenterologist search here costs about $1.53 on average, close to the $1.40 median across the 233 gastroenterologist searches measured on our state pages.
