Healthcare marketing rules by state

Fifty-one sets of rules. What changes from one state to the next is who a clinician can treat by telehealth, what a website may do with health data, and what the licensing boards allow in advertising. The table below covers all fifty states and DC; each state's page has its boards' advertising rules, its privacy law and what patients there search for. Compacts and health-data laws, state by state

“Compact routes in effect” lists the licensure compacts a clinician can use in that state today: PSYPACT where it is in effect, the Counseling Compact where it is issuing privileges to practice, and the Interstate Medical Licensure Compact (IMLC) where the state issues licenses through it. The Counseling Compact is issuing privileges to practice in ten states so far; the Social Work Licensure Compact isn't issuing multistate licenses yet. States that have passed a compact but can't use it yet aren't counted here; every compact's member list and status, state by state, is in our guide to PSYPACT and Counseling Compact states. Each state name links to its page: its licensing boards' advertising rules, its compacts and privacy law in full, and patient searches by city.

Why the state matters for marketing

An ad for online therapy or telepsychiatry should only run where the clinician can legally see the person who clicks it, and licensure compacts decide how far that reaches. A handful of states now regulate health data collected by ordinary websites, not only records covered by HIPAA, which changes what can sit on a booking page and how ad audiences are built. And patient demand differs city by city, which is what the state pages measure.

Our guide to the My Health My Data Act and other state health-data laws goes deeper on the health-data side.

Wherever the practice is, our rules don't change: no health information goes to ad platforms, booking pages ask for nothing clinical, and the ad accounts stay in the practice's name. See how we handle compliance for the details.
