Maine healthcare advertising, telehealth and privacy rules

Maine in brief. Maine is in PSYPACT, so a psychologist licensed here can apply to treat clients by telehealth in the other PSYPACT states. Maine has enacted the Counseling Compact, which wasn't live here yet when we checked. Maine has no comprehensive privacy law or consumer health data law in effect. Below: what Maine's licensing boards allow in advertising, with links to the official text.

Maine licensing boards’ advertising rules

Ads, websites and directory profiles all count as advertising to a licensing board. These are the Maine rules we check copy against, with links to the official text. Boards update their rules, so read the current version before you rely on a summary.

Maine Board of Licensure in Medicine

  • False, misleading or deceptive advertising is a listed ground for disciplining a license issued by the Board of Licensure in Medicine. This section is repealed on January 1, 2027 (PL 2025, c. 738), so check the board's rules after that date. (32 M.R.S. 3282-A(2)(I))

Maine Board of Counseling Professionals Licensure

  • Counselors commit misconduct by making claims or guarantees that promise more than they can realistically provide, or by failing to ensure their ads and directory listings give the public the information needed to choose appropriately. (02-514 C.M.R. ch. 8-A, sec. 10)

Maine State Board of Social Worker Licensure

  • Social workers may not intentionally misrepresent the type or status of their license or their qualifications, or engage in intentionally false, misleading or deceptive advertising. (02-416 C.M.R. ch. 16, sec. 1(B))

Telehealth across Maine's borders

Maine is a PSYPACT state. A psychologist whose home license is in Maine can apply for PSYPACT's telepsychology authorization and then see clients by telehealth in the other PSYPACT states, so ads can reach clients there too.

Maine has enacted the Counseling Compact, but it wasn't live here yet when we checked. Once it is, a licensed professional counselor based here can apply for privileges to practice in other member states instead of a separate license in each.

It has also enacted the Social Work Licensure Compact, which isn't issuing multistate licenses yet; the compact's commission expects its licensing system in 2027.

For physicians, psychiatrists included, Maine is in the Interstate Medical Licensure Compact, which speeds up getting a license in other member states but doesn't replace it.

Telehealth ads should only reach places where the clinician can legally treat: see PSYPACT and Counseling Compact states.

Practices near a state line often see clients from next door. New Hampshire has its own page.

Health data, tracking and Maine law

Maine has no comprehensive consumer privacy law or consumer health data law in effect as of 30 September 2026. Federal rules and a practice's own HIPAA duties still apply.

This is not legal advice.

What patients search for in Maine

Searches a month that name a Maine city, with the average cost per click, from Ahrefs (checked between 30 September and 7 October 2026). A dash means too few to measure; “near me” searches aren't counted. The Statewide row is searches that name the state.

Of the cities measured, Portland gets the most of these searches. Its biggest single search, “iop portland maine”, gets about 150 a month. To turn a cost per click into a cost per booked patient, put your own numbers into the patient acquisition cost calculator.

Across the searches measured here, Maine patients look most for IOP programs (about 300 a month), then therapists (210). Portland alone accounts for 41% of them. A click on an IOP search here costs about $9.00 on average, above the $7.00 median across the 58 IOP searches measured on our state pages.
