Arkansas healthcare advertising, telehealth and privacy rules

Arkansas in brief. Arkansas is in PSYPACT, so a psychologist licensed here can apply to treat clients by telehealth in the other PSYPACT states. The Counseling Compact is live in Arkansas. Arkansas has no comprehensive privacy law or consumer health data law in effect. Below: what Arkansas's licensing boards allow in advertising, with links to the official text.

Arkansas licensing boards’ advertising rules

Ads, websites and directory profiles all count as advertising to a licensing board. These are the Arkansas rules we check copy against, with links to the official text. Boards update their rules, so read the current version before you rely on a summary.

Every Arkansas health care practitioner

  • No one may advertise, or allow themselves to be advertised, with the title "Doctor" in connection with a healing art, except in the practice of a health care profession regulated under Arkansas professional licensing law. (Ark. Code Ann. 17-80-111)

Arkansas State Medical Board

  • Physician unprofessional conduct includes soliciting for patronage, advertising in a false, fraudulent, deceptive or misleading manner, advertising the quality of medical services, and advertising illegal procedures and practices. (Ark. Code Ann. 17-95-409(a)(2)(L))

Arkansas Psychology Board

  • Titles containing "psychology," "psychologist" or "psychological," or implying psychology practice, are for licensed individuals only (with statutory exceptions), and licensees may not use titles in a way that could reasonably confuse the public about their level of licensure. (17 CAR 95-301(b)-(c))

Telehealth across Arkansas's borders

Arkansas is a PSYPACT state. A psychologist whose home license is in Arkansas can apply for PSYPACT's telepsychology authorization and then see clients by telehealth in the other PSYPACT states, so ads can reach clients there too.

Arkansas is one of the first states where the Counseling Compact is live, so a licensed professional counselor based here can already apply for privileges to practice in the other live member states instead of a separate license in each.

It has also enacted the Social Work Licensure Compact, which isn't issuing multistate licenses yet; the compact's commission expects its licensing system in 2027.

For physicians, psychiatrists included, Arkansas is in the Interstate Medical Licensure Compact, which speeds up getting a license in other member states but doesn't replace it.

Telehealth ads should only reach places where the clinician can legally treat: see PSYPACT and Counseling Compact states.

Practices near a state line often see clients from next door. Missouri, Tennessee, Mississippi, Louisiana, Texas and Oklahoma each have their own page.

Health data, tracking and Arkansas law

Arkansas has no comprehensive consumer privacy law or consumer health data law in effect as of 30 September 2026. Federal rules and a practice's own HIPAA duties still apply.

This is not legal advice.

Across the searches measured here, Arkansas patients look most for therapists (about 620 a month), then psychiatrists (260). Little Rock alone accounts for 28% of them. A click on a therapist search here costs about $3.48 on average, below the $4.00 median across the 306 therapist searches measured on our state pages.
