Indiana healthcare advertising, telehealth and privacy rules

Indiana in brief. Indiana is in PSYPACT, so a psychologist licensed here can apply to treat clients by telehealth in the other PSYPACT states. The Counseling Compact is live in Indiana. The Indiana Consumer Data Protection Act treats health data as sensitive. Below: what Indiana's licensing boards allow in advertising, with links to the official text.

Indiana licensing boards’ advertising rules

Ads, websites and directory profiles all count as advertising to a licensing board. These are the Indiana rules we check copy against, with links to the official text. Boards update their rules, so read the current version before you rely on a summary.

Medical Licensing Board of Indiana

  • Physicians may not use, or take part in using, any public communication with a false, fraudulent, misleading, deceptive or unfair statement or claim, whether for themselves or for practitioners affiliated with them. (844 IAC 5-2-13(a))
  • A physician who claims to be "board certified", or uses similar wording, must state which board certified them and the specific field or area of certification. (844 IAC 5-2-22)

Indiana Behavioral Health and Human Services Licensing Board

  • Social workers and clinical social workers may not misrepresent their qualifications, training or experience, and any advertising must present their credentials factually. (839 IAC 1-3-4(b)(2))

Telehealth across Indiana's borders

Indiana is a PSYPACT state. A psychologist whose home license is in Indiana can apply for PSYPACT's telepsychology authorization and then see clients by telehealth in the other PSYPACT states, so ads can reach clients there too.

Indiana is one of the first states where the Counseling Compact is live, so a licensed professional counselor based here can already apply for privileges to practice in the other live member states instead of a separate license in each.

For physicians, psychiatrists included, Indiana is in the Interstate Medical Licensure Compact, which speeds up getting a license in other member states but doesn't replace it.

Telehealth ads should only reach places where the clinician can legally treat: see PSYPACT and Counseling Compact states.

Practices near a state line often see clients from next door. Illinois, Michigan, Ohio and Kentucky each have their own page.

Health data, tracking and Indiana law

The Indiana Consumer Data Protection Act, in effect since January 2026, treats health information as sensitive data. A business needs the person's opt-in consent before processing it. Most small practices fall below its size thresholds, but the ad platforms and data companies that receive website data usually don't, which is one more reason health information shouldn't reach them.

This is not legal advice.
